Terms of Service

These Terms of Service ("Terms") govern your access to and use of the TradeConnect website, platform, and related services.

By creating an account, submitting a plumbing request, responding to a job, or otherwise using TradeConnect, you agree to these Terms and our Privacy Policy.

If you do not agree to these Terms, you should not use TradeConnect.

1. About TradeConnect

TradeConnect is a platform designed to help customers connect with participating tradespeople for plumbing services.

TradeConnect may provide features that allow customers to:

• Create plumbing requests
• Describe plumbing problems
• Upload photographs and videos
• Receive responses from participating tradespeople
• Review tradesperson profiles
• Select a tradesperson
• Track certain stages of a job
• Submit ratings and reviews

TradeConnect may provide features that allow tradespeople to:

• Create professional profiles
• Submit credential information
• View eligible plumbing requests
• Respond to available jobs
• Provide estimated pricing
• Provide availability information
• Manage selected jobs
• Receive ratings and reviews

TradeConnect facilitates connections between customers and tradespeople. Unless expressly stated otherwise, Trade Connect does not itself perform plumbing work.

2. Eligibility

You must be at least 18 years old and legally capable of entering into an agreement to use TradeConnect.

By creating an account, you represent that:

• The information you provide is accurate
• You are legally permitted to use the platform
• You will comply with these Terms
• You will use TradeConnect only for lawful purposes

Trade Connect may request additional information where reasonably necessary to verify an account or protect the platform.

3. User Accounts

Certain TradeConnect features require an account.

You agree to:

• Provide accurate, current, and complete information
• Keep your account information reasonably up to date
• Maintain the confidentiality of your password and login credentials
• Not allow another person to improperly use your account
• Notify Trade Connect if you believe your account has been compromised

You are responsible for activity carried out through your account unless prohibited by applicable law.

Trade Connect may restrict access to certain features until required verification steps have been completed.

4. Customer Responsibilities

Customers using TradeConnect agree to provide accurate information about plumbing requests.

This includes, where applicable:

• The nature of the plumbing problem
• The property type
• The urgency of the problem
• The service location
• Access information
• Photographs or videos
• Preferred timing
• Other information reasonably relevant to the job

Customers should not deliberately:

• Submit false or misleading jobs
• Misrepresent the condition of a property
• Use another person's personal information without authorization
• Submit jobs they have no authority to arrange
• Harass or abuse tradespeople
• Misuse TradeConnect to obtain services unlawfully

Customers are responsible for deciding whether a tradesperson is suitable for their needs.

5. Tradesperson Responsibilities

Tradespeople using TradeConnect agree to provide accurate information about themselves, their businesses, qualifications, credentials, experience, and services.

Tradespeople must not:

• Submit false credentials
• Impersonate another person or business
• Misrepresent qualifications or experience
• Claim to hold a licence, certification, insurance, or other credential they do not hold
• Respond to jobs they are not reasonably able or authorized to perform
• Provide intentionally misleading estimates
• Misuse customer information
• Harass customers
• Use the platform for unlawful purposes

Tradespeople are responsible for determining whether they are legally permitted, qualified, properly insured, and appropriately equipped to undertake a particular job.

Tradespeople remain responsible for the quality, safety, legality, and professional standard of the services they provide.

6. Tradesperson Verification

Trade Connect may review certain information or documents submitted by tradespeople.

Verification may include:

• Email verification
• Profile review
• Account approval
• Review of an uploaded licence, certification, or credential document
• Review or verification of police certificate or other screening information where required by Trade Connect

Where TradeConnect displays a verification indicator, that indicator means only that the applicable verification steps have been completed based on the information available to us at the time.

Verification does not constitute a guarantee by Trade Connect that:

• The tradesperson will perform work satisfactorily
• Every credential remains current
• Every representation made by the tradesperson is accurate
• The tradesperson is appropriate for a particular job
• The customer will be satisfied with the work
• No dispute will arise

Customers should use their own judgment when selecting a tradesperson.

7. Plumbing Requests

A customer may create and submit a plumbing request through TradeConnect.

Trade Connect may review a request before making it available to tradespeople.

Trade Connect may:

• Approve a request
• Request clarification
• Return a request for additional information
• Decline to publish a request
• Remove or close a request
• Restrict a request where we reasonably believe it violates these Terms

Submitting a request does not guarantee that any tradesperson will respond.

Trade Connect does not guarantee:

• A minimum number of responses
• A particular response time
• That a tradesperson will be available
• That a job will be accepted
• That work will begin within a particular period

8. Information Available Before Selection

Before a customer selects a tradesperson, eligible tradespeople may be able to view information about a plumbing request.

This may include:

• Problem type
• Property type
• Description
• Urgency
• Parish
• General area
• Preferred timing
• Access notes
• Photographs
• Videos

Private information such as the customer's full service address and certain contact details may be restricted until a tradesperson has been selected.

Customers should avoid including private information in job descriptions, photographs, videos, or other fields intended to be visible to responding tradespeople.

9. Tradesperson Responses and Estimates

Tradespeople may respond to plumbing requests through TradeConnect.

A response may include:

• A message
• Availability
• An estimated price
• Other information relevant to the job

Any price provided through TradeConnect is an estimate unless expressly agreed otherwise between the customer and tradesperson .

An estimate is not necessarily a final invoice.

The final price may differ because of:

• Conditions discovered after inspection
• Parts or materials required
• Additional work
• Changes requested by the customer
• Circumstances that could not reasonably be determined from the original request

Customers and tradespeople are responsible for agreeing on the final scope, price, payment arrangements, and other service terms between themselves.

TradeConnect does not currently process payment for plumbing services through the platform.

10. Selecting a Tradesperson

Customers may choose among participating tradespeople who respond to a request.

The decision to select a particular tradesperson belongs to the customer.

Once a tradesperson is selected:

• Other responses may no longer be eligible for selection
• Additional customer contact and address information may become available to the selected tradesperson
• The customer and tradesperson may coordinate the job directly

Selection through TradeConnect does not itself create employment, partnership, agency, or joint-venture relationships between Trade Connect and the tradesperson.

11. Relationship Between Customers and Tradespeople

Tradespeople using TradeConnect operate independently from Trade Connect.

Unless expressly stated otherwise, Trade Connect is not:

• The employer of participating tradespeople
• The contractor performing the plumbing work
• A party to the plumbing service agreement between customer and tradesperson
• Responsible for setting final pricing
• Responsible for collecting payment
• Responsible for supplying materials
• Responsible for supervising the work

Any agreement concerning the actual plumbing work is between the customer and the selected tradesperson.

12. Work Progress and Completion

TradeConnect may allow selected tradespeople and customers to update the status of a job.

Status information may include:

• Selected
• Work started
• Completion pending
• Completed

These status tools are provided for convenience.

Trade Connect does not independently inspect or certify that work has actually been completed, performed correctly, or meets applicable building, plumbing, safety, or professional standards.

13. Cancellations

Customers may be permitted to cancel requests before a tradesperson has been selected, subject to the functionality available through the platform.

Once a tradesperson has been selected or work has begun, any cancellation arrangements may need to be resolved directly between the customer and tradesperson.

Trade Connect is not responsible for any separate cancellation fee, call-out fee, material cost, or other amount agreed between the customer and tradesperson.

14. Ratings and Reviews

After eligible completed jobs, customers and tradespeople may be allowed to submit ratings or reviews.

Users agree that reviews must:

• Reflect genuine experiences
• Be reasonably accurate
• Not contain threats or harassment
• Not contain unlawful or defamatory material
• Not disclose unnecessary private information
• Not be manipulated or fraudulently created

Trade Connect may remove, restrict, or decline to display reviews where we reasonably believe they violate these Terms, applicable law, or platform policies.

Trade Connect does not guarantee that every review represents the views of all users or independently verify every factual statement contained in a review.

15. Photos, Videos, and User Content

Users may submit photographs, videos, profile information, reviews, descriptions, and other content through TradeConnect.

You retain ownership of content you submit to the extent you own that content.

By submitting content to TradeConnect, you grant Trade Connect a non-exclusive, royalty-free licence to host, store, reproduce, display, process, and otherwise use that content only as reasonably necessary to operate, provide, improve, secure, and administer TradeConnect.

This licence does not transfer ownership of your content to Trade Connect.

You represent that you have the right to submit the content and that doing so does not violate another person's rights.

16. Acceptable Use

Users must not:

• Use TradeConnect for illegal activity
• Interfere with the operation or security of the platform
• Attempt to access another user's account
• Scrape or harvest personal information without authorization
• Upload malware or harmful code
• Submit fraudulent requests or responses
• Create fake ratings or reviews
• Use TradeConnect to harass, threaten, or abuse another person
• Misuse customer or tradesperson contact information
• Attempt to circumvent platform security or verification controls
• Impersonate TradeConnect or another user
• Use automated systems in a manner that damages or disrupts the platform

Trade Connect may investigate suspected misuse and take appropriate action.

17. Customer and Tradesperson Safety

TradeConnect is not an emergency response service.

If a situation presents an immediate risk to life, health, property, electricity, gas, flooding, sewage exposure, or another serious hazard, users should take appropriate safety precautions and contact the relevant emergency service, utility provider, property manager, or qualified professional as appropriate.

Information provided through TradeConnect is not a substitute for an on-site professional inspection.

18. Privacy

Your use of TradeConnect is also governed by our Privacy Policy.

The Privacy Policy explains how personal information is collected, used, shared, and protected.

19. Third-Party Services

TradeConnect may use or link to third-party services, including services related to:

• Maps
• Address lookup
• Hosting
• Email delivery
• Messaging and communications services, including WhatsApp
• File storage
• Analytics
• Other technical infrastructure

TradeConnect may use third-party messaging services, including Meta's WhatsApp Business Platform, to send service-related notifications. Use of those services may also be subject to the applicable third party's terms and privacy policies.

Trade Connect does not control every third-party service and is not responsible for third-party websites, applications, or services outside our control.

Your use of third-party services may also be subject to their own terms and privacy policies.

20. Intellectual Property

The TradeConnect platform, including its software, design, branding, logos, text, graphics, and other materials created by or for Trade Connect, is protected by applicable intellectual property laws.

Except as expressly permitted, users may not:

• Copy
• Reproduce
• Modify
• Distribute
• Sell
• Reverse engineer
• Republish
• Commercially exploit

Trade Connect intellectual property without permission.

Nothing in these Terms transfers ownership of Trade Connect intellectual property to users.

21. Platform Availability

We aim to keep TradeConnect available and functioning reliably, but we do not guarantee uninterrupted or error-free access.

TradeConnect may occasionally be unavailable because of:

• Maintenance
• Upgrades
• Technical failures
• Security issues
• Third-party service interruptions
• Circumstances outside our reasonable control

We may modify, suspend, or discontinue features where reasonably necessary.

22. No Guarantee of Results

Trade Connect does not guarantee that:

• A customer will receive a response
• A customer will find a suitable tradesperson
• A tradesperson will receive jobs
• A tradesperson will be selected
• Any estimate will match the final price
• A job will be completed successfully
• A particular result will be achieved

TradeConnect provides the platform through which users may connect and communicate.

23. Disclaimer of Warranties

To the extent permitted by applicable law, TradeConnect is provided on an "as available" basis.

Trade Connect does not make guarantees regarding:

• Continuous availability
• Error-free operation
• The conduct of users
• The quality of plumbing work
• The accuracy of every user submission
• The outcome of any customer-tradesperson relationship

Nothing in these Terms excludes rights or protections that cannot legally be excluded under applicable law.

24. Limitation of Liability

To the extent permitted by applicable law, Trade Connect will not be responsible for losses arising from the acts or omissions of independent customers or tradespeople, including disputes concerning:

• Workmanship
• Property damage
• Pricing
• Payment
• Materials
• Delays
• Cancellations
• Injuries
• Representations made by users

This section should be interpreted subject to any rights or remedies that cannot legally be excluded or limited.

25. Indemnity

To the extent permitted by applicable law, you agree to be responsible for claims, losses, liabilities, or expenses arising from:

• Your unlawful use of TradeConnect
• Your material breach of these Terms
• Content you submit unlawfully
• Your infringement of another person's rights
• Services you personally provide through TradeConnect

26. Suspension and Termination

Trade Connect may restrict, suspend, or terminate an account where we reasonably believe that:

• These Terms have been materially violated
• Fraudulent activity has occurred
• False credentials have been submitted
• Another user's safety may be at risk
• The platform is being abused
• Applicable law requires us to act
• Continued access creates a material security or operational risk

Where appropriate, we may provide notice or an opportunity to address the issue.

Serious misconduct may result in immediate restriction or suspension.

Users may also request closure of their accounts subject to applicable retention requirements described in our Privacy Policy.

27. Changes to TradeConnect

TradeConnect may add, modify, or remove platform features from time to time.

We may also change eligibility requirements, verification procedures, marketplace functionality, or other operational processes.

Where changes materially affect users' rights or obligations, we may provide appropriate notice.

28. Changes to These Terms

We may update these Terms from time to time.

The current version will be made available through TradeConnect and will display its effective date.

If changes are significant, we may provide additional notice through the platform, by email, or by another appropriate method.

Your continued use of TradeConnect after revised Terms become effective constitutes acceptance of the revised Terms where permitted by applicable law.

29. Governing Law

These Terms are governed by the laws of Barbados, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Any dispute arising from these Terms or the use of TradeConnect will be handled in accordance with applicable Barbados law.

30. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

31. Entire Agreement

These Terms, together with the TradeConnect Privacy Policy and any additional terms expressly applicable to a particular feature, form the agreement between you and Trade Connect concerning use of the platform.
